: it is a reminder of how easy it is for police and law enforcement, certainly the fbi to get the enormous amounts of fairly sensitive information about our private online activities, a lot of it without a court order. it looks like in this case it probably did get a warrant, but it also shows the incredible threat to them. we are talking about something that started as a cyber harassment investigation that led to the exposure of thousands of e-mails between broadwell and patreus over a period of years. we now have these archives of all of our communications, which compared to something like a wiretap can reveal vast more information. host: what is needed from a federal perspective to get access to the e-mails? guest: some courts have imposed tighter requirements. federal law says under certain circumstances it can be done with just a subpoena. they do not need to show probable cause of the search her home or tap your phone. only to certify that material that they are looking for is relevant. host: there is something called the electronic communications privacy act. guest: that is

generalship of the cia. >> and, suzanne, we don't know how long the fbi was investigating, do we know if the obama administration knew about this before the election? >> no, but wouldn't we all love to know the answer to that. that really is a burning question. just days after the election, something like this comes out. clearly something like this had been going on for a while. well, it actually meant he was having sex with her under the desk, but the fbi thought it might refer to corruption. in other words, doing something under the table. and that's how this investigation started. the fbi then went back and traced all of his e-mails and ascertained that he was having this affair with this woman, and of course that is a total violation of top secret security rules. you are not supposed to compromise yourself in any way where you could be blackmailed, especially the cia director. there is almost nobody in the government who knows as many secrets as he does, and people are routinely fired for putting themselves in this position when they have a top secret security clearance. what was even wo

ask you about those additional complications. it turns out the fbi found out about this because paula brock well the mistress was sending threatening e-mails to another woman whom she regarded as a threat to her relationship with petraeus. what do you know about that relationship between the other woman and petraeus? >> well, there is an fbi investigation. that is continuing. i read both the post and the times this morning and it is pretty well laid out, i think. it i hate to discuss it except to say there are a nom of things that one has to consider. the first of which was there any kind of national security breech. to date there was not. and the fbi had briefed me now. i actually wish we had been briefed a little earlier. one of the things i have tried to do is get both sides together. the chairman and share material and worked together. that is a very important concept with neither of us knowing all of this comes as a big shock, and we are very muchable to keep things in a classified setting at least if you know you can begin to think and then to plan and of course we have not had

alleged cyberharassment. the fbi tried to determine if the e-mails with petraeus' account to broadwell had-exchanged through regular e-mail exchanges or had been hawked. fbi agents believe there were no criminal charge to be brought or security implications to the case. this despite that broadwell had some classified information and seemed to be releasing information on the benghazi attack. >> i don't know if a lot of you had heard this, but the c.i.a. had taken a couple of libyan militia members prisoner and they think the attack on the on the the consulate was to get these prisoners back. >> peter king who heads the homeland security committee told nbc he had doubts that the probe ever should have happened. >> i don't know how this rises to the level of an fbi investigation. >> and senator dianne feinstein told nbc she wanted to know why the intelligence committee that she chairs weren't alerted about the ongoing investigations while some were. >> an fbi agent took it upon him to go to members of the house and tell them, and this was outside of the general line of the infor

here, a revelation uncovered by an fbi investigation into a series of e-mails sent by his biographer, paula broadwell, who was accused of sending harassing e-mails to another woman. that sparks an investigation that revealed her secret relationship with petraeus. but after looking at a recent speech she gave on the death of four americans in libya, people started wondering whether she and petraeus had shared any classified intel and whether she inadvertently spilled some of those secrets during her remarks. bill gross joins us live, what's your impression of this situation as it's playing out? >> well, it's certainly a very interesting situation, as you say. there's a joke going around on twitter that the french intelligence director resigned because he doesn't have an affair for six months. so the idea that an extramarital affair in itself would bring down the cia director is very isn't in my mind. there has to be more to the story. my guess is it has to do with internal cia politics. the agency's known to be using intelligence information to settle scores, or it could be related to

what we were told is that once someone of the director's statue comes within the scope of an fbi investigation, not the subject, but the scope, there has to be immediate briefings to the ranking members and the chairman of the house and senate intelligence committees. we are not clear, at least tonight, that that happened. >> greta: all right. when did this affair begin? when the afir is secret from it began until today, is a time that someone is potentially blackmail material. do we know -- not where itenned, but gone to the public domain. >> we don't have the specific information on when the affair began. but once the story broke, the cia director was reine, within a half hour, several people at fox got multiple folkphone calls, pointing to the author and specifically to the thyme frame in afghanistan when the biography was being written by broadwell and the cia director petraeus was the commander. we are talking about 2010, into 2011, when he took the position at the cia. >> greta: i take it when you go into the cia, there there is a security check or you fill out forms under
